Kaden Boriss incorporates Kaden Boriss Legal LLP
Kaden Boriss has once again become a pioneer in the corporate legal world by incorporating Kaden Boriss Legal LLP, which is the second Limited Liability Partnership to be registered in the field of law practice and legal services and is overall the sixth Limited Liability Partnership to be registered in India. Kaden Boriss Partners, the existing entity of the group engaged in legal practice, has been growing steadily since its inception, under the guidance of its Lead Partner, Mr. Hemant Batra. It has gone from strength to strength, by not only inducting new partners but also successfully establishing new areas of practice, so as to become a full service law firm.

Kaden Boriss is also a founding member of Orb Legal Group, a network of selected law firms operating in the Australian, Asian, European and Middle Eastern region that strive to work closely together with cross referrals of clients looking to venture in another region. The firm is currently in the process of completing the transition formalities from the partnership to LLP and shall shortly commence undertaking all new assignments and projects under Kaden Boriss Legal LLP. FoxMandal Little poaches Vinay D. Dwarkadas from Khaitan & Co.'s IP practice
FoxMandal Little (FML) has poached Mr. Vinay D. Dwarkadas at the corporate office, in his capacity as a Partner of the Intellectual Property (IP) Practice, effective today. Vinay happens to be one of the founding members of M/s. Khaitan & Co.'s IP Practice, Mumbai. Vinay is by qualification an Advocate from the Government Law College Mumbai, a registered Patent Agent with the Government of India and a Trade Mark Attorney. Vinay has during his tenure as an Advocate advised clients both, within and outside, India, on corporate, commercial and litigation matters of a diverse and extensive nature. However and since the last nine years, he has focused his practice in the field of IP Laws.

SEBI comes out with a new simplified listing agreement for debt securities

SEBI vide its circular SEBI/IMD/BOND/1/2009/11/05 dated 11.05.2009 has come out with a new simplified listing agreement for debt securities. This in SEBI's efforts to rationalize the earlier disclosure norms for listing of debt issuances. The circular relates to listing of corporate debt securities either by way of a public issue or a private placement. The new listing agreement shall come into immediate effect for all 'debt securities', as defined under regulation 2(1)(e) of the Security Exchange Board of India (Issue and Listing of Debt Securities) Regulations, 2008, seeking listing on the stock exchanges.

Anti-Competitive Agreements and Abuse of Dominance Position provisions of the Competition Act, 2002 come into effect

The Ministry of Corporate Affairs vide its notification no. S.O. 1241(E) dated 15.05.2009 has notified Section 3 and 4 of the Competition Act, 2002 dealing with anti-competitive agreements and abuse of dominance position which has now come into effect from 20.05.2009. The Central Government has also notified the establishment of the Competition Appellate Tribunal ("CAT") to be headed by Dr. Justice Arijit Paayat (Retd.) Judge, Supreme Court of India. This commission shall deal with appeals from the Competition Commission of India.

Existing firms and companies may now convert to limited liability partnerships

The Ministry of Corporate Affairs has come out with a notification stating that Schedules 2,3 and 4 and Sections 55 to 58 of the LLP Act, 2008 shall come into immediate effect from 31.05.09. Sections 55-58 deal with the conversion of a firm, private company and unlisted public company into an LLP.

Agatha Sangma, Hamdullah Sayeed and Mausam Noor, three young lawyers from FoxMandal Little (FML) have been elected as Members of Parliament in the Lok Sabha Elections, 2009 as announced on May 16, 2009. Agatha Sangma from Nationalist Congress Party (NCP), Meghalaya, Mausam Noor, Indian National Congress (INC) candidate, Maldaha (West Bengal) and, Hamdullah Sayeed, Congress Candidate, Lakshadweep, have been associated with FML for more than five (5) years in the Litigation department of FML. .

The Sarin Memorial Legal Aid Foundation and the International Institute of Air and Space Law, Leiden University launch an international air law moot

The Sarin Memorial Legal Aid Foundation and the International Institute of Air and Space Law, Leiden University (IIASL) believe in the quote above, hence the decision to launch the first of its kind, International Air Law Moot Court. This Competition is the brain child of both institutions whose main ambition is to produce successful experts in the field of air law. The combination is a novel one, with the Sarin Foundation working towards providing free legal aid to the needy in India and promoting the level of legal education amongst students in India, while the International Institute of Air and Space Law is a world renowned institute offering inter alia an advanced Master and Doctorate degrees in the field of air and space law.The moot court Competition is scheduled to be held from the 2-6th of March 2010 in New Delhi, India and offers law students from different countries the opportunity to specialise in air law, being judged by some of the most prominent judges, academia and experts in the relevant field.The Competition is aimed at promoting air law in India and worldwide, while at the same time training the participants for preparation of briefs, real life court appearances, and debating skills. United Arab Emirates enforces new rules to protect labourers

In a bid to improve the conditions of labourers, the UAE is set to introduce new rules regarding their accommodation and a mechanism for electronic payment of their salaries. The criteria will provide adequate hygienic and humane conditions for the comfort of workers. The project which is a core element in the ministry's strategy will prevent delays in payment of salaries and would benefit about 500,000 workers.

Sharia law may soon be enforced in the UK courts

Sharia law may soon be enforced in the UK if an EU plan for family courts across Europe is put in place by the government, a move that could trigger a row in Britain. Judges in Britain could be forced to bow to Sharia law in some divorce cases heard in the country. An EU plan calls for family courts across Europe to hear cases using the laws of whichever country the couple involved have close links to. For example, it could mean applying the laws of Saudi Arabia to a husband and wife living in Britain.

Pakistan Parliament moves towards enforcing Shariah in the SWAT region

Recently, the Pakistan Parliament endorsed a move to enforce Islamic laws in the restive northwestern Swat valley, which is largely controlled by the Taliban. The National Assembly adopted a resolution recommending that President Asif Ali Zardari should accord approval to the Nizam-e-Adal Regulation to implement Shariah or Islamic laws in Swat. The resolution was passed following a debate in the House. Parliamentarians of the Muttahida Qaumi Movement, which is part of the PPP-led ruling coalition, stayed away from proceedings during the voting on the resolution. The North West Frontier Province government drafted the Nizam-e-Adal Regulation after reaching an agreement in February with the Tehrik-e-Nifaz-e-Shariah Muhammadi (TNSM), a group of religious hardliners, on enforcing Shariah in Swat. In return, the TNSM began peace parleys with the local Taliban, who called a truce in the region located just 160 km from Islamabad.

Kirpan Education Bill passed by the State of California

The Californian State Assembly has passes the Kirpan Education Bill which makes mandatory the sensitisation of law enforcement officials about the religious beliefs of Sikhs particularly the kirpan. The training imparted to officers especially at airports would include advising officers about how to recognise and interact with persons carrying a kirpan. If this bill is passed by the Senate, it would be the first law in the United States specifically pertaining to the Sikh religious symbol kirpan.

Intel fined for $1.44 bn by the EU for engaging in monopoly

The European Commission fined Intel $1.44 billion for abusing its dominance in the computer chip market to exclude its only serious rival, Advanced Micro Devices. The previous record fine for similar abuses in the EU was $677 million at current exchange rates, imposed on Microsoft in March 2004 for blocking competition in markets for server computers and media software. The fine also is the largest ever imposed for any breach of competition law in the EU. Under the order, Intel must change its business practices immediately pending its appeal, although it could ask for an injunction.

Intel also must pay the fine right away, though that sum would be held in a bank account until appeals are exhausted, a process that could take years. The commission is entitled to levy fines up to 10 per cent of a company's annual global sales.

Linklaters gets new Asia head

Zili Shao has been appointed as the new managing partner of the Asian region of Linklaters with effect from 1 May, 2009. Shao has been instrumental in setting up the firm's offices in Shanghai and Beijing and has lead Linklater's China practice for little over a decade.
